1. Acceptance of Terms

By accessing or using Flock ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including game hosts, players, and visitors.

2. Description of Service

Flock is a multiplayer party game where players try to match their answers with the majority (the "flock"). The Service includes:

• Mobile applications for iOS and Android
• Web application accessible via browser
• Backend services for real-time multiplayer functionality

The Service is provided free of charge and may include advertisements.

3. User Accounts and Authentication

Flock uses anonymous authentication, meaning:

• You do not need to create an account with a password or provide personal social media login to play.
• A persistent anonymous identifier (UID) is created for your device. This identifier is used to link your display name, scores, and active game state.
• Your chosen display name is visible to other players in the same game.

You are responsible for maintaining the security of your device and any activity that occurs through your identifier.

4. User Conduct

When using Flock, you agree NOT to:

• Submit inappropriate content: Including but not limited to profanity, hate speech, harassment, threats, sexually explicit content, or content promoting violence
• Impersonate others: Use display names that impersonate real people or mislead other players
• Disrupt gameplay: Intentionally interfere with other users' enjoyment of the game
• Cheat or exploit: Use automated systems, bots, or exploits to gain unfair advantages
• Violate laws: Engage in any activity that violates applicable local, state, national, or international laws
• Reverse engineer: Attempt to decompile, reverse engineer, or hack the Service
• Spam or advertise: Use the game to promote products, services, or external websites

5. User-Generated Content

When you submit content to Flock (such as display names and game answers), you:

• Grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content for the purpose of operating the Service
• Represent that you have the right to submit such content
• Acknowledge that content may be visible to other players in your game session

We do not claim ownership of your content, and game data is automatically deleted after games end.

6. Intellectual Property

The Service, including its design, graphics, user interface, and underlying code, is owned by Flock and protected by copyright and other intellectual property laws.

You may not:

• Copy, modify, or distribute any part of the Service
• Use our trademarks, logos, or branding without permission
• Create derivative works based on the Service

7. Third-Party Services

The Service uses third-party services including:

• Google Firebase: For authentication, database, and analytics
• Google AdMob: For displaying advertisements

Your use of these services is subject to their respective terms and privacy policies.

8. Advertisements

The Service may display advertisements. By using the Service, you agree to receive such advertisements. We try to keep ads unobtrusive and relevant to maintain a good user experience.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any content

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLOCK, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the Service
• Any content submitted by other users

11. Indemnification

You agree to indemnify and hold harmless Flock and its developers from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit through the Service

12. Termination

We reserve the right to:

• Suspend or terminate your access to the Service at any time, with or without cause
• Remove or refuse to display any content that violates these Terms
• Discontinue the Service at any time without notice

You may stop using the Service at any time by uninstalling the app or closing the web page.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last updated" date at the top of this page
• Posting a notice within the app (for significant changes)

Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflicts of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation or, if necessary, through appropriate legal channels.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flock regarding the Service.
